Who we are

This policy covers MyFactor LLC (“MyFactor”, “we”, “us”), a factoring company at 146 W 29th Street, Suite 10W, New York, NY 10001. It applies to this website and to the information you give us when you apply, call, email or text us.

What we collect

• What you give us: when you apply or get in touch, your name, your business name, your contact details, and information about your business, its invoices and the customers who owe it money.
• If you become a client: the invoices and documents you send us, information about your customers, and the bank details we pay you through.
• What this website records: nothing of its own on your device. It sets no cookies and runs no analytics or tracking, as our cookie policy explains. The one exception is our application form, which HubSpot provides and protects with Google reCAPTCHA; both may set their own cookies on the application page. Like every website, the servers that host it keep standard request logs: the page asked for, the time, your IP address and your browser type.
• What we learn from others: to review an application and run an account, we may check what you tell us against business credit sources and public records, and check the credit of the customers whose invoices you ask us to buy.

How we use it

• To answer your questions and give you a rate.
• To review your application and, if you become a client, to buy your invoices, pay you, and collect from your customers.
• To check identities and invoices, and to prevent fraud.
• To send you messages about your application and your account, and marketing messages only if you have agreed to receive them.
• To keep this website running and secure, and to meet our legal, tax and accounting obligations.

Who we share it with

We do not sell your personal information, and we do not give it to other companies for their own marketing. We share it only:

• With service providers who work for us, such as our website host, HubSpot, which runs our application form and keeps our client records, and the services we use to send email and text messages. They may use it only to do that work for us.
• With the customers who owe on invoices you sell to us, to verify those invoices and collect payment, as your factoring agreement provides.
• With banks, payment processors and credit sources, to pay you and to check credit.
• When the law requires it, or to protect the rights and safety of MyFactor, our clients or others.
• With a buyer or successor if MyFactor is merged, sold or reorganized, who must honor this policy.

Text messages

If you agree to receive text messages from MyFactor, we use your mobile number only to send you the messages you agreed to. Reply STOP to any message to stop them, or HELP for help. Message and data rates may apply, and message frequency varies.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

How long we keep it

We keep information for as long as we need it for the purposes above, including for as long as the law requires us to keep business, tax and accounting records.

How we protect it

We use reasonable administrative, technical and physical safeguards to protect the information we hold, and this website is served over an encrypted (HTTPS) connection. No way of sending or storing information is completely secure, so we cannot promise absolute security.

Your choices

• You can ask to see, correct or delete the personal information we hold about you by calling (212) 466-6829 or emailing sales@myfactorllc.com. We may need to keep some records where the law or an agreement with you requires it.
• You can stop marketing emails with the unsubscribe link in any of them, and text messages by replying STOP.

Children

Our services are for businesses. This website is not directed to children, and we do not knowingly collect information from anyone under 13.

Other websites

Our application form appears on our Apply page but is HubSpot’s, and what you type into it goes to us through HubSpot. Some links here take you to other companies’ websites, including the fuel card application with Multi-Service Fuel Cards. Their privacy policies apply there, not this one.

Changes to this policy

If we change this policy, we will post the new version on this page with a new “last updated” date.
